Mon Co. sues entities for failing to pay more than $100K in hotel taxes

MORGANTOWN – The Monongalia County Commission is suing D&M Investments after it claims the hotel failed to pay on the county’s hotel tax.

Alan B. Mollohan, Robert Holt Mollohan and Kathryn Nelson were also named as defendants in the suit.

The commission and Monongalia County Sheriff and Treasurer Perry Palmer claim the commission enacted an amended ordinance regarding hotel tax on June 4, 2007, and it was confirmed June 27, 2007, according to a complaint filed April 3 in Monongalia Circuit Court.

The plaintiffs claim the defendants own and operate a Ramada Inn and Conference Center in Morgantown that is subject to the hotel tax ordinance.

The defendants have failed to pay the hotel taxes that were due in 2015 and 2016, according to the suit, and a total hotel tax of $121,687.86 was due and owing.

The plaintiffs claim the defendants agreed to pay the amount and only paid the sum of $10,000.

The defendants have failed and refused to abide by the agreement it made with the plaintiffs in failing to pay the remaining $111,687.86.

The plaintiffs are seeking a lien made on the defendants until they paid the amount owed. They are being represented by Phillip M. Magro.
