BECKLEY — A Kanawha County heating and air conditioning parts supplier is suing a Shady Spring contractor, alleging breach of contract in failing to pay nearly $41,000.
Ferguson Enterprises Inc. filed a complaint April 25 in Raleigh Circuit Court against Clay Heating & Air Conditioning Inc. alleging the contractor failed to perform its financial obligations under terms of a contract.
According to the complaint, between June 2016 and February 2017, Ferguson sold materials and supplies to Clay Heating on credit. To date, the principal amount of $39,109.63 remains due and owing, plus interest. The plaintiff alleges Clay Heating has failed and refuses to make payments for this amount.
Ferguson Enterprises seeks trial by jury, seeks damages of at least $40,998.51, plus pre- and post-judgment interest, attorney fees, collection costs and all just and appropriate relief. It is represented by attorney Mary K. Prim of Scott Depot.
