Raleigh County authority alleges heating, air conditioning system is defective

BECKLEY — A Raleigh County unit is suing a contractor and subcontractor, alleging breach of contract.

The Raleigh County Emergency Services Authority filed a complaint April 28 in Raleigh Circuit Court against J. Dan Snead, J. Dan Snead & Associates Inc. and Clingenpeel, McBrayer & Associates Inc., alleging they have failed to install a properly working heating-air conditioning system.

According to the complaint, the authority suffered damages from not being unable to control the temperature in its 911 dispatch center and for the monetary costs incurred for the repair of the HAVC system. 

The plaintiff alleges the defendants failed to remedy and/or cure the defects at the authority's 911 center within the reasonable period of time.

The Raleigh County Emergency Services Authority seeks trial by jury, payment for all damages suffered, attorney fees, court costs and expenses and all other just and proper relief. It is represented by attorneys W. Bradley Sorrells and David K. Higgins of Robinson & McElwee PLLC in Charleston.
