BECKLEY — A Beckley couple is suing an insurance company, alleging unfair claims settlement practices.
Jimmy Harvey and Teresa Harvey filed a complaint April 27 in Raleigh Circuit Court against State Auto Property and Casualty Insurance Company alleging failure to fulfill its contractual obligations.
According to the complaint, on June 24, 2016, the Harveys' camper trailer was destroyed by a massive flood. The plaintiffs say they made a claim for insurance benefits that were promised by State Auto but they have been unsuccessful in doing so.
The Harveys said they suffered loss of insurance proceeds, annoyance and inconvenience. The plaintiffs allege State Auto Property has failed and refuses to pay the plaintiffs $8,985.
The Harveys seek trial by jury, compensatory and punitive damages, attorney fees, court costs and all other appropriate relief. They are represented by attorneys Kevin B. Burgess, Christopher B. Frost and Steven R. Broadwater Jr. of Hamilton, Burgess, Young & Pollard PLLC in Fayetteville.
