Employee alleges benefits plan administrator violated law

HUNTINGTON — A Kentucky woman is suing a plan administrator, alleging breach of contract and denial of ERISA benefits.

Genka Popov filed a complaint May 3 in U.S. District Court for the Southern District of West Virginia againstUniversity Physicians & Surgeons, Inc., Long Term Disability Plan, Northwestern Mutual Life Insurance Company and Does 1 through 5, alleging they denied the plaintiff's claim for disability benefits.

According to the complaint, in 2016, Popov became disabled and applied for disability benefits, which were denied. She alleges the defendants have violated the Employment Retirement Income Security Act (ERISA). 

Popov seeks all benefits due, monetary judgment, interest, legal fees and all other relief the court deems just. She is represented by attorney Mark F. Underwood of Underwood Law Offices in Huntington.
