Kanawha County couple alleges financial business violated law

WINFIELD — A Kanawha County couple is suing a financial business and an insurance company, alleging negligence and violation of state law.

Paul Michael Thumm Sr., and Lisa Thumm filed a complaint May 4 in Putnam Circuit Court against Horizon Financial Solutions, Inc., and American Equity Investment Life Insurance Company, alleging they sold their product to the plaintiffs which accumulated significantly less interest than the promised guaranteed rate.

According to the complaint, the Thumms suffered monetary damages because the defendants sold a fixed deferred annuity to the plaintiffs.

The Thumms seek trial by jury, compensatory damages, incidental and consequential damages, punitive damages, legal fees, interest and all other relief the court deems just. They are represented by attorneys Stuart A. McMillan and Patrick C. Timony of Bowles Rice LLP in Charleston.
