Employee blames mine operator for severe leg injuries

PINEVILLE — A Raleigh County man is suing a mine operator and support services, alleging deliberate intent and negligence led to injuries for the plaintiff.

Paul Blaylock filed a complaint May 3 in Wyoming Circuit Court against Markfork Coal Company Inc. and Maxxim Shared Services LLC, ,alleging that they breached their duties of good faith and fair dealing.

According to the complaint, on May 8, 2015, Blaylock, who worked as a mechanic/welder for Manfork, sustained severe and profound injuries to his right leg that required surgery and subsequent amputation, 

The suit says Blaylock suffered physical pain, mental anguish, impairment, lost wages, and incurred medical expenses as a result of the defendants' negligence to replace the motor at the same time a belt was being advanced, creating a hazard to the plaintiff that resulted in his leg injury. 

The plaintiff alleges the defendants failed to follow safety standards and procedures, and allowed Blaylock to work on a dangerous assignment without adequate warning or communication.
