Industrial services supplier alleges supply company broke law

FAYETTEVILLE — A West Virginia industrial supplier is suing consignees, alleging breach of contract.

J.P. Industrial Services Inc. filed a complaint April 24 in Fayette Circuit Court against H M Supply LLC and W.R. Murdock & Sons Inc., doing business as Murdock Hydraulics, alleging failure to to perform their contractual obligations.

According to the complaint, on Nov. 30, 2015, J.P. Industrial transferred machine parts to the defendants on consignment for the purpose of their sale. The suit says J.P. Industrial was damaged financially for not receiving an accounting of the parts liquidated and returned. 

The plaintiff alleges W.R. Murdock & Sons took possession of the parts and did not deliver it. The suit says the defendants have failed to respond to the plaintiff's request for an accounting of the parts.

J.P. Industrial Services seeks trial by jury, judgment, jointly and severally, of up to $75,000 to compensate the plaintiff, plus interest, attorney fees and court costs and all other just and proper relief. It is represented by attorney Randall L. Veneri of Veneri Law Offices in Princeton.
