WHEELING — A Wheeling woman is suing a Pennsylvania transport business and a driver, alleging negligence, and vicarious liability in running over the plaintiff.
Romona Finley filed a complaint May 9 in the Ohio Circuit Court against Smith Transport and Scott Palmer, alleging Palmer failed to exercise standard care and skill required in operating a vehicle.
According to the complaint, on Feb. 23, Finley was a pedestrian crossing toward the parking area in front of Windsor Manor in Wheeling. The suit says Palmer negligently pulled a vehicle owned by Smith Transport out of a parking spot and struck the plaintiff.
As a result, the suit says, Finley sustained severe and life-altering injuries, pain and suffering, emotional distress, fear and anxiety, disability, scarring and medical expenses, and will require surgical intervention and assistance and support for the rest of her life.
The plaintiff alleges Smith Transport failed to train and educate an employee on proper vehicle operation, Palmer failed to adequately check surroundings before operating the vehicle, and failed to timely apply the breaks.
Finley seeks trial by jury, compensatory and punitive damages, interest, costs of suit and all other proper relief. She is represented by attorneys Eric Chaffin and Patrick Booth of Chaffin Luhana LLP in Pittsburgh.
