Woman names 136 companies in asbestos suit

CHARLESTON – A woman is suing 136 companies she claims are responsible for her late husband’s lung cancer and death.

 

Kenneth Ray Kidd died of lung cancer on April 16, 2015, of lung cancer, according to a complaint filed April 13 in Kanawha Circuit Court.

 

Connie Kidd claims Kenneth Kidd was employed at Ashland Inc. in 1965 and then in the 1960s and 1970s, he performed home construction, remodeling work and drywall work for several different employers throughout West Virginia.

 

From 1975 to 1979, Kenneth Kidd was employed in a coal mine, according to the suit.

 

Connie Kidd claims from 1965 to the late 1970s, Kenneth Kid was exposed to and inhaled dust and asbestos fibers, which caused his lung cancer.

 

Kenneth Kidd suffered from lung cancer and died from it in 2015, according to the suit.

 

Connie Kidd claims the defendants failed to advise Kenneth Kidd of the dangerous characteristics of their asbestos and asbestos-related products; failed or omitted to provide Kenneth Kidd with the knowledge as to what would be reasonably safe and sufficient wearing apparel and property protective equipment and appliance.

 

The defendants failed and omitted to take reasonable precautions or to exercise reasonable care to publish, adopt and enforce a safety plan and a safe method of handling and installing the asbestos and asbestos materials, according to the suit.

 

Connie Kidd is seeking compensatory and punitive damages. She is being represented by Brian A. Prim of Prim Law Firm; and Michael J. Gallucci of Savinis & Kane.

 

The case is assigned to Circuit Judge James C. Stucky.
