WHEELING — A Wheeling woman has filed a class action lawsuit against telemarketers, alleging violation of telephone harassment statutes.
Diana Mey filed a complaint, individually and on behalf of all persons and entities similarly situated, May 8, in U.S. District Court for the Northern District of West Virginia against Festiva Development Group Inc. and Allen Marketing Group Inc., alleging they violated the Telephone Consumer Protection Act in making several telemarketing calls to the plaintiff without consent.
According to the complaint, Mey suffered damages from receiving several automated telemarketing calls from the defendants despite her request to stop calling.
Mey seeks trial by jury, enjoin the defendant, injunctive relief, statutory damages of $500 for each negligent violation and $1,500 for each knowing violation, all legal fees and all other relief the court deems just.
