Daughter accuses insurance company of breach of contract

KEYSER — A Mineral County woman is suing administrator is suing an insurance company, alleging breach of contract.

Tina Lynch, individually and as administrator of the estate of Forrest J. Boggs III, her father, and Cynthia Rounds, another daughter, filed a complaint May 9 in Mineral Circuit Court against Life Insurance Company of North America, alleging it wrongfully demanded the plaintiff to return of benefits from a life insurance policy. 

According to the complaint, Lynch was damaged from being informed that a mistake was made and that the funds given her should be returned. The plaintiff alleges the defendant had removed the balance from the plaintiff's account.

Lynch seeks trial by jury, damages to compensate the plaintiff and other punitive damages. She is represented by attorneys James M. Barber of Law Office of James M. Barber in Charleston, and by Nelson Michael and David Collins of Nelson Michael LLC in Keyser.
