Federal retiree alleges government agency incorrectly continues monthly deductions

BLUEFIELD — A federal retiree is suing a government agency, alleging non-termination of monthly deductions.

Miachel H. Hicks of Raleigh County filed a complaint May 5 in U.S. District Court for the Southern District of West Virginia against United States Office of Personnel Management alleging that the political subdivision failed to provide satisfactory answer as to when this monthly deductions will stop.

According to the complaint, despite his former wife's death on June 7, 2013, Hicks has continued to pay the sum of $172.38 for her ex-wife monthly annuity. The plaintiff alleges the defendant failed to stop the withdrawal of the monthly benefits for his ex-wife.

Hicks seeks trial by jury, an order to stop the withdrawal of $172.38 from his monthly annuity, award the improper withholding from his monthly annuity for $7,067.58, attorney fees, court costs and all other proper relief.
