MOUNDSVILLE — A Moundsville man is suing trailer park property owners, alleging their negligence caused injuries to his son.

William M. Whitelach, individually and as father and next friend of minor child Braden Whitelach, filed a complaint May 15 in Marshall Circuit Court against Charles and Deborah Helinski, AAA Mobile Homes Inc. of New Martinsville, doing business as AAA Homes and AAA Mobile Homes Inc., alleging they failed to properly secure a Labrador retriever that was present on the property.

According to the complaint, on Aug. 23, 2016, Braden Whitelach suffered injuries to his face, nose and chin from being attacked by a dog owned by the Helinskis on the trailer park property in Moundsville. The plaintiff alleges the defendants failed to warn the Whitelachs of the dangerous condition and the bite risk of the Labrador retriever.

Whitelach seeks trial by jury, judgment in an amount that exceeds the jurisdictional threshold of this court, monetary damages, legal fees, interest and all other just relief. He is represented by attorney David A. Jividen of Jividen Law Offices PLLC in Wheeling.
