Marshall County Coal Company, McElroy Coal Company accused of negligent mining operations

MOUNDSVILLE — Two West Virginia residents are suing the Marshall County Coal Company and the McElroy Coal Company for alleged negligence.

Mark H. Frye and Lisa Fonner filed a complaint in Marshall Circuit Court, alleging that the defendants caused damages to the plaintiffs' property due to mining operations.

According to the complaint, the plaintiffs allege that they suffered property damages, including loss of natural water sources and damage to their septic system. The plaintiffs hold the defendants responsible for allegedly causing damages to the property as the result of their mining operations.

The plaintiffs request a trial by jury and seek judgment against the defendant in an amount sufficient to compensate them for damages, punitive damages, interest, all legal fees and any other relief this court deems just. They are represented by Eric M. Gordon of Berry, Kessler, Crutchfield, Taylor & Gordon in Moundsville.
