Softball player blames Huntington parks for injuries near restroom

HUNTINGTON — A Cabell County woman is suing the Huntington parks department, alleging its negligence led to injuries for the plaintiff. 

Samantha L. Ashworth filed a complaint May 11 in Cabell Circuit Court against the Greater Huntington Parks and Development District, alleging failure to maintain a safe premises.

According to the complaint, on May 12, 2015, Ashworth was playing softball at the defendant's field at St. Cloud's Commons. While going to the portable toilet, the suit says, Ashworth tripped on a metal protrusion and fell face first onto broken concrete pieces. 

The lawsuit states Ashworth sustained injuries to her knee, shoulder and eye, resulting in pain and suffering, medical expenses and loss of income. The plaintiff alleges the parks district negligently failed to inspect the premises and eliminate the existence of a dangerous condition.

Ashworth seeks trial by jury, compensatory damages, plus interest, attorney fees, court costs and all other equitable relief. She is represented by attorney Paul A. Ryker of Barboursville.
