PRINCETON — A Mercer County couple is suing a North Carolina tractor trailer owner and operator, alleging their negligence caused injuries.
Kelly G. Allen and Heather N. Allen of Athens, West Virginia, filed a complaint May 11 in Mercer Circuit Court against Danny Ray Campbell and JRJ Trucking LLC, alleging Campbell negligently left an overturned tractor trailer on Interstate Highway 77.
According to the complaint, on Nov. 4, 2016, the Allens incurred injuries to themselves and damage to their car when they violently collided with a JRJ Trucking's tractor trailer that blocked both lanes of Intestate 77 near Princeton. The suit says the Allens suffered great pain, emotional distress, medical expenses of more than $13,000 and loss of the use of their vehicle.
The plaintiffs allege Campbell left the disabled tractor trailer in the middle of I-77 and failed to take any steps to warn the traveling public of the dangers of the overturned vehicle.
The Allens seek trial by jury, plus compensatory and punitive damages to deter others from similar misconduct in the future. They are represented by attorneys Lane O. Austin and Brandon L. Austin of Sanders Austin & Flanigan in Princeton.
