Couple alleges mining companies ruined property

MOUNDSVILLE — A Marshall County couple is suing mining companies, alleging the defendants damaged the plaintiffs' property.

Michael D. Stern and Amy Stern filed a complaint May 18 in Marshall Circuit Court against The Marshall County Coal Company and the McElroy Coal Company, alleging violation of the Surface Coal Mining and Reclamation Control Act.

According to the complaint, the Sterns suffered the loss of property and water supply, diminution of value and loss of the use of their property, annoyance and inconvenience. The plaintiffs allege the defendants constructed a long-wall adjacent to or above their property in Cameron District, failed to correct the plaintiffs' damages and/or to compensate them for the damages.

The Sterns seek trial by jury, damages sufficient to compensate for the plaintiffs' damages, punitive damages, interest, court costs and attorney fees, plus all other just and proper relief. They are represented by attorney Eric M. Gordon of Berry, Kessler, Crutchfield, Taylor & Gordon in Moundsville.
