ELKINS — Two West Virginia residents are suing Branch Banking and Trust Company for alleged breach of contract and breach of duty in a mortgage loan dispute.
Franklin Perrine and Edward Hall, administrator of the estate of Chrystal Hall, filed a complaint on May 19 in the U.S. District Court for the Northern District of West Virginia, alleging that the defendants refused to honor a loss-of-life payment protection plan.
According to the complaint, the plaintiffs allege they suffered monetary damages as the result of paying for a protection plan that was never in effect. The plaintiffs also claim that the loan agreement that Chrystal Hall had entered into with the defendant included a loss-of-life payment protection plan. After she passed away, the plaintiffs inquired about the plan. The defendants then allegedly informed them that the plan was voided.
The plaintiffs hold the defendants responsible for allegedly accepting their payment for the plan and not informing them that it was voided.
The plaintiffs request a trial by jury and seek actual damages, civil penalties, all legal fees, and any other relief this court deems just. They are represented by Jason E. Causey and James G. Bordas, Jr. of Bordas & Bordas PLLC in Wheeling.
