Widow alleges sues nursing home failed to provide proper care for husband

CHARLESTON — A Mercer County woman is suing a Kanawha County nursing home, alleging negligent supervision in the care of her husband.

Patsy A. Rowe, executor of the estate of Johnny Rowe filed a complaint May 24 in Kanawha Circuit Court against Princeton Center LLC, alleging failure to provide a safe handling and care for all residents suffering with mental, physical and emotional disabilities.

According to the complaint, on March 24, 2015, the plaintiff's husband, Johnny Rowe, was found missing at the defendant's Glenwood Park facility. The suit says he had no pants on, and the center knew he suffering with dementia and he should have been monitored closely. Patsy Rowe alleges her husband cannot be blamed for leaving the facility and should not have been discharged and blacklisted from other nursing home. 

The lawsuit states Johnny Rowe was alone outside the facility in 42-degree weather and suffered physical injuries that led to his death in October 2015.

The plaintiff alleges Princeton Center failed to adequately staff, train, supervise, monitor employees to ensure they knew how to implement proper interventions to prevent elopement, failed to fully assess whether the facility could meet the safety needs of patients and failed to provide the building facility safety devices and care needs required to keep patient safe.

Patsy Rowe seeks trial by jury, all damages allowed by law and all appropriate relief. She is represented by attorneys Tony I. O'Dell and Cheryl A. Fisher of Tiano O'Dell, PLLC in Charleston.
