Former patient accuses Genesis Healthcare of failing to prevent fall

CHARLESTON — A former patient is suing Genesis Healthcare LLC, 1000 Association Drive Operations LLC, 302 Cedar Ridge Road Operations LLC, John Does 1 through 10 and Unidentified Entities 1 through 10 for negligence.

Frank McCallum filed a complaint May 26 in Kanawha Circuit Court alleging that the defendants failed to provide him with proper medical care.

According to the complaint, the plaintiff alleges that he suffered physical injuries in September 2016, including a fractured hip due to suffering a fall. The plaintiff holds the defendants responsible for allegedly failing to supervise him in order to prevent him from falling.

The plaintiff seeks damages, general and special damages, punitive damages, all legal fees and any other relief this court deems just. He is represented by James B. McHugh, Michael J. Fuller Jr., D. Bryant Chaffin and Kendra R. Fokakis of McHugh Fuller Law Group PLLC in Hattiesburg, Miss.
