WAYNE — A Wayne County man is suing mining companies, alleging negligence led to injuries for the plaintiff.
Dany Bragg of Kermit, West Virginia, filed a complaint April 26 in Wayne Circuit Court against Old ANR LLC, formerly known as Alpha Natural Resources Inc., Rockspring Development Inc. and Maxxim Shared Services LLC, alleging failure to comply with industry safety standards and practices.
According to the complaint, on May 31, 2015, Bragg was severely injured when the front end loader he was operating at Camp Creek Mine No. 460512 bounced up and down slamming him onto the seat of the loader. The suit says Bragg sustained a compression fracture of the L1 vertebrae and other spine-related injuries.
The plaintiff alleges the defendants negligently instructed him to engage in an unsafe and dangerous condition and failed to maintain their equipment in a reasonably safe condition.
Bragg seeks a trial by jury, compensatory damages, pre- and post-judgment interest, costs of court and all other relief the courtdeems reasonable. He is represented by attorney D. Geoffrey Varney in Huntington.
