WAYNE — A Kentucky woman is suing Kenova, alleging negligence led to injuries at the city's pool facility.
Erma D. Van Horn filed a complaint May 3 in Wayne Circuit Court against The city of Kenova alleging breach of statutory duty to keep its public areas free from nuisance.
According to the complaint, on March 31, 2015, Van Horn was in the parking lot of Kenova's Dreamland Pool facility. While walking through the grassy area, the suit says, Van Horn stepped into a knee-deep hole with her right foot.
The lawsuit states Van Horn sustained a fracture to her right ankle which required surgery. The plaintiff alleges Kenova negligently failed to inspect and correct the defective condition and to warn visitors about such defects.
Van Horn seeks trial by jury, judgment in an amount to which plaintiff is justly entitled. She is represented by attorney Michael C. Walker of Cyrus, Adkins & Walker in Huntington.
