Children allege medical care providers' negligence led to father's death

CHARLESTON — A son and daughter are suing Kanawha County medical care providers, alleging the defendants' negligence led to the death of the plaintiffs' father. 

William F. Eskew IV and Emily C. Eskew, co-executors of the estate of William F. Eskew III, filed a complaint June 1 in Kanawha Circuit Court against Dr. Robert Bongchul Shin and the Charleston Area Medical Center Inc., alleging they negligently deviated from the applicable standards of medical care and treatment.

According to the complaint, as a result of the defendants' negligence, William Eskew III suffered massive hemorrhage, chronic anemia and died Sept, 4, 2015. The plaintiffs say they suffered great mental pain and anguish, loss of service, society and guidance of the deceased. 

The plaintiffs allege the defendants failed to explore and adequately drain William F. Eskew III's intra-abdominal abcess.

The Eskews seek trial by jury, compensatory and punitive damages, plus legal interest and all other equitable. They are represented by attorneys Richard D. Lindsay and Ray W. Toney of Tabor, Lindsay & Associates in Charleston.
