HUNTINGTON — Five Cabell County property owners are suing a neighbor and electric company, alleging trespassing.
Melissa Harmon, Shannon Diaz, Paul Marcum, Virgie Edgell and Steve Mahan, heirs of Linda Gale Marcum, filed a complaint May 25 in Cabell Circuit Court against American Electric Power Company Inc. and Raymond Lee Armstrong, alleging Armstrong sold and conveyed easement and right-of-way to American Electric that overlapped the plaintiffs' property.
According to the complaint, as a result of defendants' actions, the plaintiffs' property was damaged and will continue to be damaged until a decision is rendered in their favor. The plaintiffs allege the defendants trespassed on the plaintiffs' property without any right to do so and without plaintiffs' authority. The suit says the defendants down approximately 150 trees to construct transmission tower and refused to engage in good faith discussion.
The plaintiffs seek trial by jury, an injunction order that the defendants cease any activities which will cause additional damage to the plaintiffs' property, all damages, plus interest, costs and all other just and proper relief.
