BECKLEY — A woman is suing Wesley D. Finney, a motorist, and Gallagher Coal Research Center Inc., the motorist's employer, for alleged negligence and vicarious liability.
Beulah Mae Reed filed a complaint on June 8 in the Raleigh County Circuit Court, alleging that the defendants failed to the exercise standard care and skill required in operating a vehicle.
According to the complaint, the plaintiff alleges that while she was traveling along Fearn Street on July 17, 2015, Finney failed to yield the right of way and caused the truck owned by his employer to collide with the motor vehicle driven by plaintiff. As a result of defendants' negligence, plaintiff suffered injuries to her body, physical limitations, inconvenience, pain and suffering and incurred medical expenses.
The plaintiff holds the defendants responsible for allegedly failing to operate vehicle in a safe and proper manner and for failing to properly train and supervise an employee who operated the vehicle.
The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory and punitive damages, interest, attorney's fees, costs, expenses and further relief the court deems just.
