Maskell Pipe & Supply Inc. allegedly failed to pay $15,500 in rental fees

PHILIPPI — An equipment renter is suing Maskell Pipe & Supply Inc., a contractor, for allegedly breaching a verbal agreement.

Williams Excavating LLC filed a complaint on June 2 in the Barbour County Circuit Court, alleging that the defendant failed to fulfill its contractual obligations.

According to the complaint, the plaintiff alleges that defendant contracted plaintiff on Dec. 9, 2015 to rent two fusion machines, inserts, roller stands and a heater. The defendant allegedly still owes $15,557.42. The plaintiff holds the defendant responsible for allegedly refusing to acknowledge and pay the full amount due.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount in excess of the jurisdictional limits of the court and such other relief as the court may deem appropriate. The plaintiff is represented by Karl Kolenich of Klie Law Offices PLLC in Buckhannon.
