BECKLEY — A motorist is suing Industrial Transport Inc. for alleged negligence and vicarious liability.
Mark Philpott filed a complaint on June 8 in the Raleigh County Circuit Court, alleging that the company's agent failed to exercise the standard care and skill required in operating a vehicle.
According to the complaint, the plaintiff alleges that he was operating a motor vehicle along Interstate 77 on June 12, 2015. When he allegedly stopped at the tollbooth, the vehicle owned by the defendant, which was driven by one of its employees, slammed into the rear of his vehicle, causing the plaintiff's vehicle to collide with a trailer truck that was stopped in front of his vehicle. As a result of the alleged negligence of defendant's agent, the plaintiff suffered severe injuries to his body, emotional distress and incurred medical expenses.
The plaintiff holds the defendant responsible for allegedly failing to adequately maintain and operate a motor vehicle so as not to cause harm.
The plaintiff requests a trial by jury and seeks judgment against defendants, award compensatory and punitive damages, interest, attorney's fees, costs, expenses and further relief the court deems just.
