New Martinsville accuses Liberty Mutual of contract breach

WHEELING — A West Virginia city is suing Liberty Mutual, alleging breach of an insurance contract.

The city of New Martinsville filed a complaint June 15 in U.S. District Court for the Northern District of West Virginia Wheeling Division against Liberty Mutual Insurance Company, alleging failure to honor its own obligation.

According to the complaint, New Martinsville is the owner-operator of the Martinsville Hydroelectric project on the Ohio River. On July 10, 2014, the suit says, one of the units shut down due the damage and has been non-operational for nearly three years. The plaintiff alleges it has suffered substantial business interruption and lost revenues because Liberty Mutual has refused to accept New Martinsville's claim and denied coverage for damages sustained by plaintiff's insured property.

The city seeks trial by jury, monetary judgment of more than $22 million, plus interest, attorney fees, court costs and all just and equitable relief. It is represented by attorneys Carolyn G. Flannery and Logan Hassig of Snyder & Hassig in New Martinsville.
