CHARLESTON — A Lincoln County woman is suing a West Virginia state agency, alleging a hostile work environment and wrongful or constructive eviction.
Lisa Dawn Clay filed a complaint June 19 in Kanawha Circuit Court against the West Virginia Department of Health and Human Resources alleging violation of the West Virginia Human Rights Act.
According to the complaint, on June 28, 2016, Clay, who had worked for the defendant for 13 years, was constructively discharged from employment, causing her to suffer lost wages and benefits, indignity and humiliation. The plaintiff alleges the defendant recklessly disregarded her rights by subjecting her to sexual harassment and by creating a hostile work environment.
Clay seeks trial by jury, all damages, pre-judgment interest, attorney fees and court costs and all other just and equitable relief. She is represented by attorneys Mark A. Atkinson of Atkinson & Polak PLLC in Charleston and by W. Jack Stevens of Stevens & Stevens in Hamlin.
