Chauncey property owner accuses Nationwide of contract breach

Insurance 09

LOGAN — A Chauncey property owner is suing Nationwide Insurance, alleging breach of an insurance contract.

Linda Blevins filed a complaint June 19 in Logan Circuit Court against Nationwide General Insurance Company, alleging breach of covenant and good faith and fair dealing.

According to the complaint, the plaintiff alleges that, on March 14, Blevins' insured property on 48 Godbey St., Chauncey, was damaged by fire while Nationwide's policy was in full force.

Blevins said she notified Nationwide of the fire loss but has yet to receive payment. The plaintiff alleges Nationwide has wrongfully refused and continues to refuse to make an offer of settlement and breached its duty to promptly investigate the plaintiff's loss.

Blevins seeks trial by jury, all insurance benefits, economic loss, consequential damages, pre- and post-judgment interest, attorney fees, legal fees and costs and all other appropriate relief. She is represented by attorney Christopher J. Heavens of Heavens Law Firm PLLC in Charleston.
