Elderly consumer accuses lender, mortgage service, holder of illegal practices

PRINCETON — An 80-year-old Bluefield woman is suing a mortgage lender, service and holder, alleging unconscionable inducement.

Joan Imogene Ferguson, who describes herself as an unsophisticated consumer, filed a complaint June 19 in Mercer Circuit Court against Citifinancial Inc. Bayview Loan Servicing LLC and John Doe, alleging they persuaded the plaintiff into an unwise loan secured by her home.

According to the complaint, as a result of the defendants' actions, Ferguson suffered worry, annoyance, stress and fear of losing her home. The plaintiff alleges the defendants failed and refused to apply her payments on the mortgage account of her Bluefield home.

Ferguson seeks trial by jury, declaration the loan is unenforceable, actual and consequential damages, attorney fees, court costs and penalties and all other appropriate relief. She is represented by attorney Daniel T. Lattanzi of Pepper & Nason in Charleston.
