MOUNDSVILLE – A former West Virginia resident currently residing in North Carolina alleges that he was terminated because of his age by Williams Energy Resources.
Ernest Kyle Earley filed a complaint on June 26 in Marshall Circuit Court against Williams Energy Resources LLC, Donald Fernald, David Duke and Casey Tominack alleging age discrimination.
According to the complaint, the plaintiff worked for Williams Energy Resources from June 2013 until his termination in April 2016. He alleges he and other employees were terminated as part of a reduction in force but alleges the personnel retained were much younger and had less experience.
The plaintiff holds Williams Energy Resources LLC, Fernald, Duke and Tominack responsible because the defendants allegedly terminated plaintiff's employment due to his age, which was 56 at the time.
The plaintiff requests a trial by jury and seeks compensatory damages, general damages, punitive damages, interest, all legal fees and any other relief as the court deems just. He is represented by Nicholas A. Wininsky of Wininsky Law Offices in Pittsburgh, Pennsylvania. The case has been assigned to Circuit Court Judge David W. Hummel Jr.
