Gary's Body Shop alleged to owe insurance company for corrective repairs

WHEELING – An insurance company alleges it is owed reimbursement from an individual and Triadelphia body shop over corrective repairs to its customer's vehicles.

State Farm Mutual Automobile Insurance Co. filed a complaint on June 26 in the Ohio Circuit Court against Gary's Body Shop Inc. and Gary L. Bitzer Jr. alleging breach of contract, unjust enrichment and negligence.

According to the complaint, Bitzer entered into a service agreement with the plaintiff in 2015 for the defendant to make repairs on vehicles owned by plaintiff's insureds. The suit states that two vehicles were taken to the defendants for repairs and that the plaintiff reimbursed the defendants for them, but the vehicle owners were not satisfied with the repairs and took their vehicles to different facilities for corrective repairs.

The plaintiff alleges it made several attempts to obtain reimbursement from the defendants for the cost of the corrective repairs but has received no response.

The plaintiff requests a trial by jury and seeks compensatory damages, restitution, interest, all legal fees and any other relief as the court deems just. It is represented by Jordan V. Palmer of Flaherty Sensabaugh Bonasso PLLC in Wheeling. The case has been assigned to Circuit Judge James P. Mazzone.
