KEYSER — A Piedmont couple is suing the American Legion, alleging negligence led to a motor vehicle crash that injured the plaintiffs.
Kathy Denise Broadwater and Christopher Allen Broadwater filed a complaint June 23 in Mineral Circuit Court against Daniel Tilden Wolfe and American Legion 52, Kelly-Mansfield Home Club Post, also known as Kelly Mansfield Post 52 doing business as Kelly Mansfield Home Club Inc., alleging failure to to properly control a motor vehicle.
According to the complaint, the Broadwaters suffered physical injuries from a head-on collision Aug. 5, 2016 on McMullen Highway near Rawlings, Maryland. The suit says their car was hit by a vehicle driven by Wolfe. The plaintiffs say the suffered injuries and emotional distress and required hospitalization
The plaintiffs allege the defendants served alcohol to Wolfe and allowed him to operate a vehicle while grossly intoxicated.
The Broadwaters seek trial by jury and all medical expenses that exceed $50,000. They are represented by attorneys Daniel R. James and Nicholas T. James of James Law Firm PLLC in Keyser.
