Family member blames hospital operator for relative's death

Medical malpractice 02

CHARLESTON — A Milton man is suing a South Charleston hospital operator, alleging negligence caused the wrongful death of a relative.

Gilbert W. Sloan, executor and personal representative for the estate of Icley Wood Sloan, filed a complaint June 21 in Kanawha Circuit Court against Herbert J. Thomas Hospital Association, alleging hospital employees negligently deviated from the accepted standard of medical care.

According to the complaint, on Feb. 17, 2016, Icley Sloan, 88, choked while she was attempting to eat a dried turkey sandwich which eventually led to her death March 11, 2016. The suit says her beneficiaries suffered sorrow, mental anguish and guidance.

The plaintiff alleges the defendant's staff failed to perform oral and respiratory care and failed to properly diagnose, discover and treat Icley Sloan's medical condition.

Gilbert Sloan seeks trial by jury, judgment in an amount that will fairly compensate the decedent's beneficiaries, for the losses they suffered, plus all relief the court deems just and proper. He is represented by attorneys J. Timothy DiPiero, Lonnie C. Simmons and Robert M. Bastress III of Ditrapano, Barrett, DiPiero, McGinley & Simmons PLLC in Charleston.
