Westfield Insurance Co. alleged to have failed to pay man's underinsured motorist claim

HUNTINGTON – A Cabell County man alleges his insurer has refused to pay his claims in relation to a collision with an underinsured motorist.

Melvin J. Miller Jr. filed a complaint on June 23 in Cabell Circuit Court against Westfield Insurance Co. alleging breach of contract, unfair trade practices and common law bad faith.

According to the complaint, the plaintiff alleges that on May 8, 2015, he suffered injuries and special damages caused by the negligence of an underinsured motorist in Chesapeake. 

The plaintiff holds Westfield Insurance Co. responsible because the defendant allegedly failed to offer a fair and reasonable value for plaintiff's damages under his policy through the defendant.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, interest, attorney's fees and costs. He is represented by Amy C. Crossan of Bouchillon, Crossan & Colburn LC in Huntington. The case has been assigned to Circuit Judge Gregory L. Howard.
