LOGAN – A Logan County woman claims that a debt collector wrongfully disclosed an alleged debt to a third party in an effort to coerce payment from her.
Melissa S. Kemp filed a complaint on June 30 in the Logan Circuit Court against Cabell Huntington Hospital Inc. alleging violation of the West Virginia Consumer Credit and Protection Act and other counts.
According to the complaint, the plaintiff alleges that the defendant is attempting to collect a disputed debt and that it mailed information to a person with no connection to the alleged debt. She also claims that the defendant falsely threatens that it will collect attorney's fees in invoices it sends.
The plaintiff requests a trial by jury and seeks compensatory damages, statutory damages, punitive damages, interest, court costs and any further relief the court grants. She is represented by Troy N. Giatras and Matthew Stonestreet of The Giatras Law Firm PLLC in Charleston. The case has been assigned to Circuit Judge Joshua Butcher.
