CHARLESTON – A Dunbar man alleges that his decedent was not properly monitored after a surgery in Kanawha County.
James L. Downey Jr., as administrator of the estate of Gregory S. Downey, filed a complaint on June 30 in the Kanawha Circuit Court against CAMC Health System Inc., doing business as CAMC or Charleston Area Medical Center, and John A. DeLuca, M.D. alleging negligence and vicarious liability.
According to the complaint, the DeLuca performed a colonostomy on Gregory S. Downey at CAMC in August 2015, and a surgery was later done in December 2015 by the defendants. The suit states that Gregory S. Downey died on Dec. 7, 2015.
The plaintiff alleges that the defendants failed to properly monitor Gregory S. Downey's care following his surgery.
The plaintiff requests a trial by jury and seeks medical expenses, exemplary and compensatory damages, damages, all legal fees and any other relief as the court deems just. He is represented by Scott W. Andrews of Hoover Andrews, PLLC in Barboursville. The case has been assigned to Circuit Judge Charles E. King.
