Huntington Health and Rehabilitation Center, others accused of wrongful death

HUNTINGTON – A Huntington woman has filed suit against a nursing home over allegations that its negligence contributed to her decedent's death.

Maria Webber, as personal representative of the estate of Katherine Foley, filed a complaint on June 30 in Cabell Circuit Court against Seventeenth Street Associates LLC, doing business as Huntington Health and Rehabilitation Center; SavaSeniorCare Administrative Services LLC; and SavaSeniorCare Consulting LLC alleging negligence, wrongful death and other counts.

According to the complaint, Foley was a resident at the defendants' Huntington Health and Rehabilitation Center from Sept. 3 to Sept. 24, 2016. The plaintiff alleges that during her stay there, Foley suffered from ulcers, infections and dehydration. The suit states that Foley died on May 7, 2017.

The plaintiff holds Seventeenth Street Associates LLC, SavaSeniorCare Administrative Services LLC and SavaSeniorCare Consulting LLC responsible because the defendants allegedly failed to monitor Foley's condition and failed to timely provide the services to prevent her ailments.

The plaintiff requests a trial by jury and seeks all damages, all legal fees, punitive damages and any other relief as the court deems just. She is represented by Matthew P. Stapleton and Scott G. Stapleton of Stapleton Law Offices in Huntington. The case has been assigned to Circuit Judge Paul T. Farrell.
