Consumers claim Ford Explorer doesn't conform to warranty

FAYETTEVILLE – An Oak Hill couple is seeking a refund of the purchase price of a vehicle they claim does not conform with its new vehicle warranty.

James Perdue and Ann Perdue filed a complaint on June 29 in Fayette Circuit Court against Ford Motor Co. alleging violation of West Virginia codes.

According to the complaint, the plaintiffs purchased a used 2014 Ford Explorer from an authorized retail dealer in August 2014. They allege that the vehicle has nonconformities with its new motor vehicle warranty and that the use and market value of the vehicle has been impaired.

The plaintiffs hold Ford Motor Co. responsible because the defendant allegedly did not conform the vehicle to the warranty or replace it after numerous attempts to do so.

The plaintiffs request a trial by jury and seek damages, all legal fees and any other relief as the court deems just. They are represented by Christopher B. Frost of Hamilton, Burgess, Young & Pollard PLLC in Fayetteville.
