PRINCETON – A woman alleges her home was foreclosed upon as the result of the actions of a financial institution.
Diana Woodard filed a complaint on July 3 in the Mercer Circuit Court against Branch Banking and Trust Co. alleging breach of contract, constructive fraud and other counts.
According to the complaint, the plaintiff and her estranged husband obtained a loan from the defendant in 2003 to purchase a manufactured home. The suit states that in 2015, the plaintiff notice that the defendant was no longer making automatic withdrawals from her checking account for payments and found the loan had been sold to Specialized Loan Servicing LLC. The plaintiff alleges that Specialized Loan Servicing refused to take her payments and as a result, the loan became delinquent and the property went to foreclosure.
The plaintiff requests a trial by jury and seeks damages, court costs and attorney fee. She is represented by Gary M. Smith of Mountain State Justice Inc. in Charleston. The case has been assigned to Circuit Judge Derek C. Swope.
