Consumer accuses Capital One Bank of making unlawful collection calls

PRINCETON – A man alleges that a debt collector has caused his phone to ring with the intent to annoy, abuse or oppress.

Stephen Pugh filed a complaint on July 3 in the Mercer Circuit Court against Capital One Bank (USA) N.A. alleging violation of the West Virginia Consumer Credit and Protection Act.

According to the complaint, the plaintiff alleges that the defendant has been contacting him in its attempt to collect an alleged debt. The plaintiff holds Capital One Bank (USA) NA responsible because the defendant allegedly engaged in unreasonable or oppressive or abusive conduct with its phone calls.

The plaintiff seeks actual damages, statutory damages, attorney fees, compensatory damages, punitive damages and other relief as the court shall deem meet and proper. He is represented by Ralph C. Young, Christopher B. Frost, Steven R. Broadwater Jr. and Jed R. Nolan of Hamilton, Burgess, Young & Pollard PLLC in Fayetteville. The case has been assigned to Circuit Judge William J. Sadler.
