Injured passenger seeks underinsured motorist benefits from Nationwide Mutual

NEW CUMBERLAND – A Weirton woman alleges an insurance company effectively denied her claim for underinsured motorist benefits.

Erica D. Conkle filed a complaint on July 3 in the Hancock Circuit Court against Nationwide Mutual Insurance Co. alleging violation of West Virginia code.

According to the complaint, the plaintiff alleges that she was injured in an accident as a passenger on state Route 2 on Jan. 13, 2014, when the vehicle she was in hydroplaned. The suit states she settled her claim with the driver and his insurer but was not made whole, so she submitted an underinsured motorist claim with the defendant.

The plaintiff holds Nationwide Mutual Insurance Co. responsible because the defendant allegedly has failed to offer any adequate sum to compensate her for her injuries.

The plaintiff seeks all damages, punitive damages, pre- and post-judgment interest, attorney fees, general and special damages and other relief the court deems proper. She is represented by M. Eric Frankovitch and Kevin M. Pearl of Frankovitch, Anetakis, Simon, Decapio & Pearl LLP in Weirton. The case has been assigned to Circuit Judge Ronald E. Wilson.
