Couple seeks underinsured motorist benefits from State Farm

HUNTINGTON – A Putnam County couple is seeking damages from an insurer after a collision in 2013.

Virginia Scott and Phillip Scott filed a complaint on July 3 in the Cabell Circuit Court against Tyler Angle and State Farm Mutual Automobile Insurance Co. alleging negligence and bad faith.

According to the complaint, Virginia Scott was injured in a collision in Cabell County on Dec. 27, 2013, when Angle struck her vehicle. The suit states that Angle's insurance was not sufficient enough to cover Scott's damages and that State Farm has refused to cover the plaintiffs' claim for underinsured motorist benefits.

The plaintiffs request a trial by jury and seek compensate the plaintiff for economic and non-economic damages, punitive damages, attorney's fees, pre- and post-judgment interest, and such further relief deemed appropriate by the court. They are represented by James R. Fox of Fox Law Office PLLC in Hurricane. The case is assigned to Circuit Judge Paul T. Farrell.
