WHEELING – A patron at a Triadelphia restaurant alleges an improperly marked step caused her to fall.
Charlotte Ann Elder filed a complaint on July 5 in the Ohio Circuit Court against Z&S International Cuisine Inc., doing business as Fusion Japanese Steakhouse of Wheeling, alleging negligence.
According to the complaint, the plaintiff alleges that on July 21, 2015, she was having a meal on defendant's Triadelphia property when she fell down a step on the way to the restroom. As a result of the alleged negligence of the defendant, plaintiff claims she sustained injuries and damages including pain and suffering, emotional distress, medical expenses and inconvenience.
The plaintiff holds Z&S International Cuisine Inc. responsible because the defendant allegedly failed to properly mark or light the step and failed to give effective warning or notice of the hazardous condition.
The plaintiff requests a trial by jury and seeks judgment against defendant for compensatory, special and general damages, punitive damages, attorney's fees, interest, costs of action and other relief to which she is entitled.
