Man sues Kanawha-Roxalana Company for injuries

CHARLESTON – A man is suing Kanawha-Roxalana Company for injuries suffered from a fall.

Real Estate Resources Inc. was also named as a defendant in the suit.

On July 15, 2015, Richard A. Miller was walking on or about the handicap access ramp on the defendants’ premises and/or the sidewalk and/or other common areas outside of the premises within the common areas of the premises, according to a complaint filed July 12 in Kanawha Circuit Court.

Miller claims he slipped and fell on the inadequately maintained walkways in the common areas due to the defendants’ negligence in failing to maintain walkways in the common areas, handicap ramp and walkways in a a fair and reasonable condition for their intended use.

The defendants failed to properly maintain the premises and failed to maintain the sideway, handicap ramp and/or common paved areas and other common areas, according to the suit.

Miller claims he suffered injuries to his back, face, extremities, hips, mouth and teeth and exacerbation of pre-existing degenerative conditions in the plaintiff’s back and neck; pain and suffering; medical expenses; lost wages; loss of future wages; permanent injury; future damages; and other general damages.

Miller is seeking compensatory damages. He is being represented by William C. Forbes and W. Jesse Forbes of Forbes Law Offices.

The case is assigned to Circuit Judge James Stucky.
