Dollar General shopper claims she was injured when knocked into store display

CHARLESTON – A Cross Lanes woman alleges that she was injured in a Dollar General store when a delivery man came into the store and knocked her into a display.

Julie Eads filed a complaint July 7 in Kanawha Circuit Court against Dean Transportation Inc. DolGenCorp LLC, John Doe and John Doe Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 11, 2016, she was shopping at the Dollar General store when a Dean Transportation delivery man came in the front door, causing his dolly/door to strike the plaintiff and knock her into a store display. She alleges she sustained injuries to her right arm and shoulder.

The plaintiff holds Dean Transportation Inc., DolGenCorp LLC, John Doe and John Doe Inc. responsible because DolGenCorp allegedly was negligent in its design and decoration of the store and John Doe negligently failed to keep a proper lookout.

The plaintiff requests a trial by jury and seeks damages of more than $75,000, attorney's fees, costs and all other and further relief. She is represented by Paul M. Stroebel of Stroebel & Johnson PLLC in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
