Gilbert Distributing customer alleges negligence caused fall

WILLIAMSON – A Gilbert woman has filed suit against a Mingo County auto care business she fell on the premises.

Helen Carter filed a complaint on July 10 in the Mingo Circuit Court against The Gilbert Distributing Co., doing business as Gilbert Distributing Inc., Pit Stop Fast Lube and G.D.C., alleging negligence.

According to the complaint, the plaintiff took her car to the defendant's premises for an oil change on July 17, 2015. She alleges she exited her vehicle and fell because of the elevated ground level.

The plaintiff holds The Gilbert Distributing Co. responsible because the defendant allegedly was careless and negligent to direct her to drive her vehicle onto a service rack because it put her in an unsafe condition.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount that exceeds the jurisdictional limits of this court. She is represented by Bruce L. Freeman of Freeman & Chiartas in Charleston. The case has been assigned to Circuit Judge Miki J. Thompson.
