CHARLESTON – A Kanawha County man claims that Mardi Gras Casino & Resort did not pay his winnings.
Rocky Scarberry filed a complaint July 13 in Kanawha Circuit Court against Racing Corp. of West Virginia, doing business as Mardi Gras Casino & Resort, alleging conversion and fraud.
According to the complaint, the plaintiff alleges that on April 27, the defendant removed him from the premises after he won a $1,730 hand-pay jackpot and that he was forced to leave without his winnings. The suit states that the defendant alleges the plaintiff was removed because he voluntarily self-excluded himself from the premises, but the plaintiff argues he has excluded himself before.
The plaintiff requests a trial by jury and seeks damages, interest, punitive damages, all legal fees and any other relief as the court deems just. He is represented by Mark S. Plants of Plants Law Offices in South Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
